New Twist To Shangisha Landlords’ Claim As Faction’s Lawyer Says Execution Is Illegal
A new twist to the current effort of the Shangisha Landlords Association to reclaim their land at the Magodo Phase II estate has emerged.
Castles Lifestyle can authoritatively report that there is a split in the ranks of members of the association with one faction opting for a reconciliatory parley with the Lagos state government. This faction, through their lawyer, Chief Bolaji Ayorinde, SAN, of BA LLP we gathered has gone as far as suing the faction led by Mr. Adebayo Adeyiga that is attempting to forcefully implement the Supreme Court judgment.
Castles earlier reported that there was palpable fear among Magodo estate residents on Tuesday as anti-riot policemen and bulldozer was sighted at the estate entrance while hundreds of youths apparently by the Shangisha Landlords Association were seen marking various houses within the estate.
A call by this reporter to the law firm also confirmed the issuance of the letter on behalf of the faction. Mr. Adenrele Adegorioye, a Senior Partner with the law firm affirmed that there are indeed factions within the association and that Mr. Adebay Adeyiga does not have the backing of the majority of the members of the association.

According to the law firm, Mr. Adebayo Adeyiga does not have the consent of their client to initiate the process of the execution of the Supreme Court judgment through the request of a Warrant of Possession and Warrant of Execution purportedly on behalf of the 549 Judgment Creditors.

In a letter sighted by Castles Lifestyle titled, ‘Illegal Execution Carried Out On 21st December 2021 In Respect Of The Judgment In Suit No: ID/795/1988 Between Military Governor Of Lagos State And Others V. Adebayo Adeyiga And Others Which Is Pending At The Court Of Appeal, Lagos State’, the law firm asserted that:

They had filed an Appeal by way of Cross-Appeal on behalf of their clients in Appeal Number CA/L/1005/2018 challenging the decision of Honourable Bankole Oki of the High Court of Lagos in setting aside the proceedings wherein the Warrant of Possession Form N dated 16th March 2017 issued by the Chief Judge in favour of Adebayo Adeyiga was nullified.

Two issues they noted were up for determination by the Court of Appeal were: Whether the Honourable Chief Judge of Lagos State can issue and sign a Warrant of Possession/Execution in favour of Adebayo Adeyiga on behalf of the other 548 Judgment Creditors even though he did not have their authority to do same and whether Honourable Justice Adebiyi had acted properly in setting aside the Writ of execution/Possession issued to Adebayo Adeyiga.
According to the lawyers, the act of Mr. Adebayo Adeyiga and the Police in trying to carry out the execution is illegal and should be condemned.
